Defense lawyer Tom Mesereau repeatedly asked Constand if she had abided by its terms, which barred her from initiating criminal charges against him.
Defence lawyers had similarly attacked her credibility in June when the first trial on these charges against Cosby ended in a mistrial after jurors became deadlocked. The former Temple University basketball administrator was later released from the stand after almost two days of questioning. Judge Steven O'Neill ruled that Jackson can take the stand at the retrial but said he might revisit the issue after Constand finished testifying. She said Cosby touched her breasts and vagina and used her hand to stroke his penis while she was incapacitated. Jackson has said that she and Constand worked closely together, had been friends and had shared hotel rooms several times. In this call, Gianna Constand tried to ask when Cosby would send her the name of the drug he gave to her daughter when she was allegedly assaulted.
Andrea Constand returns to the courtroom on the sixth day of Cosby's sexual assault retrial at the Montgomery County Courthouse in Norristown, Pennsylvania, April 16, 2018.
The protection law firm then inquired, "Did you create a scheme to falsely accuse him for the money?" She denied understanding her.
4 5, Constand, testified last week which Cosby sexually assaulted and knocked out her with pills.
Mesereau also pointed out that Constand made phone calls to Cosby after the alleged assault, including on Valentine's Day.
Constand, 45, left the witness stand Monday after testifying for seven hours over two days.
She told jurors that she was concerned because her daughter hadn't been the same since leaving Temple in March 2004 and moving back to Canada, screaming in her sleep and waking up in a sweat.
Andrea Constand described her relationship with Cosby as a mentorship because Cosby wanted to help her break into the broadcasting industry.
"He said to me, 'Don't worry, Mom, there was no penile penetration, '" Gianna Constand testified. She also insisted she doesn't know a key defense witness who plans to testify that she spoke of making false accusations against a celebrity to make money.
She has testified that she saw Cosby as a mentor and had no romantic interest in him. The defence has called the other accusers irrelevant to the case.
Cosby, 80, has said their sex was consensual, and has pleaded not guilty to three charges of aggravated indecent assault. And she said her phone calls to Cosby were about basketball and had nothing to do with romance.
Constand, the former director of operations for women's basketball, alleged she was drugged and sexually assaulted by Cosby, a former member of the Board of Trustees, at his Montgomery County home in 2004.
Mesereau is trying to persuade the jury to see Constand as an unrequited lover who acted inappropriately by showing interest in the long-married Cosby.
Mesereau, in his cross-examination of Constand, asked her about inconsistencies in her statements to police about the alleged assault.
Gianna Constand said she called Cosby on the phone and recorded their conversation after her daughter told her of the alleged assault.
"You think you called Mr. Cosby to talk about basketball?"
Prosecutors in his retrial were allowed to seek tetimony from as many as five other women who claim Cosby also drugged and assaulted them.
Casting further doubt about the allegations, " Mesereau said Constand told authorities she called Cosby out of her phone that was university-issued just before she came to the night time of this attack to guarantee the gate would be available in his house.
But Mesereau, who's best known for winning Michael Jackson an acquittal in his 2005 child molestation case, was incredulous as Constand denied being aware that Cosby was sexually attracted to her - even after he touched her thigh on one occasion and tried unbuttoning her trousers on another.
Constand explained that she may have been mistaken, that there were times Cosby told her in advance that the gate would be open and that she often reached him at another number.
The Associated Press doesn't typically identify people who say they're victims of sexual assault unless they grant permission, which Constand has done.
